Under Colorado law, Third-Degree Assault is a Class 1 misdemeanor punishable by a county jail sentence of up to two years and a fine of up to $5,000. Third-Degree Assault is one of the few misdemeanor charges in Colorado that, for enhanced sentencing purposes, is considered an extraordinary risk crime.
Assault in the Third Degree, as defined in Title 18 of the Colorado Revised Statutes, is committed when a person knowingly or recklessly causes bodily injury to another or negligently causes bodily injury to another by means of a deadly weapon.
Third-Degree Assault is most commonly charged in domestic violence cases in which one party claims the other caused them physical harm, but without the infliction of serious injuries or the use of a weapon. Third-Degree Assault also is a common criminal charge in situations involving bar fights and physical disputes.
