Denver Probation Violation Lawyer

Having a warrant or being served with a probation complaint in Colorado is scary. The penalties for a probation violation can be harsh. Typically, a judge will view a breach of probation as a serious allegation, and a break in the trust originally placed in the defendant. Once an arrest warrant or summons has been served, a court hearing will be set before the original sentencing judge. There is no right to a jury for this hearing. The government need only prove to the judge by a preponderance of the evidence that at least one term of probation was breached by the defendant. If the government meets this relatively low burden, the judge can sentence up to the maximum penalties for the original conviction.
