Denver probation violation lawyer Criminal defense attorney for probation violators

Denver Probation Violation Lawyer

Having a warrant or being served with a probation complaint in Colorado is scary. The penalties for a probation violation can be harsh. Typically, a judge will view a breach of probation as a serious allegation, and a break in the trust originally placed in the defendant. When a probation officer or prosecutor elects to make a complaint, all penalties for the original conviction are possible. Depending on the original criminal conviction, these penalties include prison or county detention. Other possible penalties include community service, longer probation terms, increased levels of supervision, monitored sobriety, alcohol or drug therapy, and increased fines and court fees.

In Colorado, probation and supervised release is monitored at the federal, state, local and private levels. Often, county courts will contract with private probation companies, such as Intervention and Rocky Mountain Offender Management Services, to provide supervision and substance monitoring. Private companies are often used to monitor misdemeanor and DUI probation. In addition, many of the court ordered programs are not provided through the probation department. For example, the Denver Adult Probation Department will supervise felony offenders, while misdemeanors and DUI probation in Denver may be supervised through Intervention.

The Tiftickjian Law Firm, P.C. has an established reputation for mitigating the surrounding circumstances and erroneous assumptions made by probation officers and prosecutors that trigger probation complaints. As a Colorado criminal defense attorney and former state prosecutor, Mr. Tiftickjian has handled hundreds of felony and misdemeanor probation complaints, and has experience to negotiate with prosecutors and probation officers regarding pending complaints. We have experience representing clients facing felony, misdemeanor and DUI probation complaints in Colorado.

Including Criminal Allegations Such As:

Once an arrest warrant or summons has been served, a court hearing will be set before the original sentencing judge. There is no right to a jury for this hearing. The government need only prove to the judge by a preponderance of the evidence that at least one term of probation was breached by the defendant. If the government meets this relatively low burden, the judge can sentence up to the maximum penalties for the original conviction.
