As early as 2011, a DUI for THC in your blood test will be a misdemeanor in Colorado. Being introduced to Colorado is law to establish the presumed THC blood level for a DUI charge in Colorado. This bill criminalizes driving in Colorado with a tetrahydrocannabinols (THC) blood content of 5 nanograms or more.
The Colorado DUI law proposal calls for Colorado Revised Statutes 42-4-1301(2) to include a misdemeanor crime of DUI for having a THC blood content of five nanograms or more. This law also provides that if a person’s THC content was five nanograms or more, a permissible inference is raised that the suspect was DUI for being under the influence of drugs.
The Colorado Department of Revenue will also initiate a marijuana driver’s license revocation action against your driver’s license for a positive THC blood test. The Colorado DMV offers no eligibility options for an early reinstatement like it would for a first time alcohol-related DUI revocation.
